A former Baylor University student, James K. Shadle, 23, was sentenced to 10 years of felony probation on Monday, but with a crucial condition: he must first serve 180 days in prison. The sentence comes after Shadle pleaded guilty to two reduced charges of attempted sexual assault in a plea agreement with the McLennan County District Attorney’s Office.
The crime, which involved the sexual assault of another Baylor student, occurred in December 2021. Shadle was initially indicted on two counts of sexual assault.
McLennan County 19th State District Court Judge Thomas West accepted the plea agreement, adding the upfront prison time as a condition of the probation and ordering Shadle to pay $1,525 in restitution to the victim. Shadle, who had been free on bond, was taken into custody immediately after sentencing and will be transferred to prison from the McLennan County Jail. He must serve the entire 180-day sentence before being released to probation supervision on a sex offender caseload. Judge West stated his reluctance to accept the plea deal, having previously rejected an initial agreement in March that offered deferred probation.
The reduced charges mean Shadle will be required to register as a sex offender for 10 years, rather than a lifetime, and faced a maximum penalty of 10 years in prison instead of 20.
Prosecutor Will Hix expressed gratitude for the victim's bravery and hoped the prison time would serve as a "wake-up call" for Shadle. "It is only due to the incredibly brave choice made by her to come forward, coupled with quick action by highly supportive friends, that put us in a position to be able to monitor the actions of this offender for many years to come," Hix said.
In a powerful statement to Shadle after the sentencing, the victim detailed the profound and lasting trauma caused by the assault, affecting her and her entire family. She described a loss of trust, particularly towards men, debilitating anxiety, fear of attending college classes, and panic attacks. She also spoke of constant neck pain, a physical reminder of the assault, and difficulty breathing that felt like the "crushing weight of his body on top of hers."
According to arrest records, the victim, also a Baylor student, reported that on December 4, 2021, Shadle invited her to his room where he attempted to remove her clothes and stated he was "going to have sex with her." Despite her repeated refusals, the arrest affidavit alleges Shadle forced her to perform oral sex and then "forcefully laid on top of her, rendering her unable to move, then 'vigorously' sexually assaulted her." Shadle reportedly made several admissions of sexually assaulting the victim to other individuals.
Shadle, of Cypress, was a vocal performance and music education major at Baylor before his arrest and subsequent expulsion from the university.
