Student Arrested at MacArthur High School for Possession of THC

In a recent incident at MacArthur High School, 17-year-old Carlos Daniel Reyes was arrested on January 11, 2024, at approximately 11:00 am, after being discovered in possession of THC on school premises. Officer Dallatorre, the School Resource Officer (SRO) at MacArthur, made the arrest.

Reyes is facing charges related to possession of a controlled substance, specifically "possession of a controlled substance in Penalty Group 2 less than 1 gram in a drug-free zone," which is categorized as a third-degree felony in Texas.

The substance in question, THC, is the psychoactive chemical found in marijuana. Under Texas law, any product containing a Delta-9 THC amount of 0.3% or greater is considered a controlled substance.

Drug Penalty Group 2 Possession Punishment in Texas

According to Tex. Penal Code § 1.07(a)(39), the range of punishment is dependent on the weight/ amount a person has in their possession.

In this case the quantity of THC was less than 1 Gram (POSS CS PG2 <1G) so the charge Reyes is facing is a State Jail Felony in Texas, and the potential consequences include imprisonment in a state jail facility for a period ranging from 180 days to two years, along with a possible fine not exceeding $10,000.
