IRVING, Texas - An Irving man was arrested after police say he assaulted his wife during a domestic disturbance that escalated into a confrontation involving the victim's son.
According to investigators, officers responded on May 25 to a residence in the 1300 block of Rusdell Drive in South Irving after receiving a report of a family violence incident.
Police said a 44-year-old woman reported that she had been arguing with her husband, identified as 36-year-old Daniel Aaron Wharton Sr. During the dispute, the victim alleged that Wharton struck her in the head multiple times, causing swelling and a cut to the left side of her face.
The victim's son reportedly heard the disturbance and came to the rescue of his Mom. He burst into the bedroom and intervened to stop the assault. Authorities said the son then became involved in a physical confrontation with his stepfather.
Officers arrived just in time, before the fight became deadly. The victim met the officers at the door and was visibly shaken, pleading for their quick help in separating her son and husband.
Investigators spoke to all involved, observed visible injuries on the victim and determined there was probable cause to arrest Wharton.
He was booked into the Irving Jail on charges of:
- Assault Family Violence Causing Bodily Injury (Misdemeanor)
- Assault Family Violence Causing Bodily Injury with a Previous Conviction (Third-Degree Felony)
Police said the felony enhancement stems from a prior domestic violence conviction. Records show Wharton was convicted of domestic violence assault in October 2013 in Macomb County, Michigan.
Following his arrest, Wharton posted bond and was released from custody.
